Civil Liability Act 2018
The Civil Liability Act will come into force on 31st May 2021 and has been designed by the Government to help prevent fraudulent whiplash claims that cost the insurance industry billions of pounds per year and drive up the cost of insurance premiums for all drivers like you.
Critical changes to whiplash claims
A fixed tariff of claim values is now in place.
The Ministry of Justice has implemented a new official injury claim portal
Insurers will now have just 30 days from the date the claim is submitted to admit or deny liability.
What this means for you
If you or your passengers are injured during a road traffic accident resulting in a whiplash claim is essential that the claim is reported immediately as failure to do so could result in you not receiving a payment.
For customers with legal expenses protection added to their insurance policy, the legal team will administer the claim and process the details through the portal on your behalf.
If you do not have legal cover in place, you will need to instruct a solicitor to claim on your behalf.
Why have legal cover?
This additional cover will protect you if you incur any uninsured financial losses due to an accident that was not your fault.
Uninsured financial losses may include loss of earnings, personal injury, vehicle recovery within the United Kingdom, loss or damage to personal property and policy excesses under a comprehensive policy. This cover also includes credit repair.
Legal services protection provides cover of up to £100,000 under the terms of the policy.
